| Consumer Commission censures New India Assurance Co | | ‘Gave award of Rs.5 lakh along with interest for damaged vehicle’ | | Jammu Feb-05- Censuring the New India Assurance Company for its arbitrary and capricious decision to refuse the insurance cover for the damaged vehicle, the Jammu and Kashmir Consumer Disputes Redressal Commission gave an award of Rs. five lakhs along with interest @ 8 per cent from the date the Surveyor submitted the report i.e. September 5, 2005 till date along with cost of the complaint amounting to Rs. 6,000. The Commission headed by Justice (Retd) G D Sharma with Khalid Hussain as Member took serious note of arbitrary decision of the Insurance Company and observed that the vehicle in question, which was especially designed for carrying Ice Cream in a refrigerated condition, met with an accident on April 24, 2003 near Peera while coming from Srinagar to Jammu. Though it was a total loss of the vehicle but still then the Insurance Company refused to indemnify the complainant on the basis that the vehicle could be repaired when there was expert opinion to the contrary. The complaint which was pending in the Commission for the last more than three years was decided by the Commission today by awarding Rs. 5 lakhs along with interest. |
