| Consumer Commission dismisses PCO holder’s appeal | | | Early Times Reporter Jammu | Feb 7 Dismissing the complaint of a PCO holder filed against the BSNL, as being non-maintainable, Jammu and Kashmir State Consumer Disputes Redressal Commission headed by Justice (Retd) G D Sharma land Khalid Hussain Member, in a significant judgment, after hearing the counsel for the parties held that franchise holders of STD PCO functioning in the State on behalf of the Telecommunication Department (BSNL) are not their consumers and they cannot claim enhancement of commission fee. The Commission further held that rather the persons who are getting this service from STD PCO owners are their consumers. This view has been held on the view that these franchise holders are getting the commission for rendering those services which otherwise would have been directly rendered by the BSNL itself to their telephone consumers, the Commission observed. This significant judgment was given in a complaint filed against BSNL by PCO holder Raj Singh s/o Puran Singh of village Satrarian RS Pura, before the Commission on February 4, 2005, claiming therein an enhanced rate of commission from 20 per cent to 50 per cent. The claim amounted to Rs.26, 65, 120 as rebates commencing from January 1,1996 to January 1,2004 along with compensation of Rs. two lakhs for torture and harassment and litigation charges of Rs.25, 000. The 50 per cent increase was claimed as per the circular and policy of Government of India announced from January 1, 1996. |
