| Anomaly in JEs grades challenged | | HC directs placement of petitioners in higher scales | | Early Times Reporter Jammu | Feb 9 Justice YP Nargotra of Jammu and Kashmir High Court, Jammu Wing, while deciding a petition filed by Atta Mohammed and other Junior Engineers, who were placed in the pay scale of 1400-2300 (unrevised) at the time of their initial appointment, directed the respondents to accord consideration to the cases of the petitioners for their placement in the grade of 1760-3200 (unrevised) under rules subject to their eligibility. The petitioners in their petition submitted that Junior Engineers appointed earlier to them were placed in the pay scale of 1760-3200(unrevised) and sought Court directions for placing them in the similar grade. While directing the respondents, Justice Nargotra observed that Adv C M Koul appearing for the petitioners submitted that the case of petitioners is fully covered by the judgment rendered in the case of Roshan Din Choudhary Vs State. He further submitted that petitioners would be satisfied if the respondents are directed to accord consideration to their cases for their placement in the higher grade keeping in view the said judgment. On the other hand, AAG SC Gupta submitted that the respondents would have no objections for considering the cases of petitioners in the light of above said judgment provided they are eligible under rules. While according such consideration, Justice Nargotra said the judgment of Roshan Din Choudhary Vs State shall also be kept in view. The petitioners shall provide a copy of the said judgment and any other record which they want to rely in support of their case to the competent authority. The respondents shall take decisions in the matter within a period of two months. JNF |
