| Court awards 17 years imprisonment to two ISI agents | | | Early Times Reporter Jammu | Feb 14 Principal Sessions Judge, Jammu, Mr. JR Kotwal awarded 17 years imprisonment to Mohammed Aslam alias Zahoor Ahmed s/o Mohd Ashraf r/o Dharcy Tehsil and District Bagh, Pakistan and Manzoor Ahmed alias Umar s/o wali Mohammed r/o Dherkot District Bagh Pakistan. Principal Sessions Judge, after hearing Public Prosecutor EA Tak appearing for the State and Adv Rupak Ratta appearing for the accused, observed that the offence committed by both the accused are heinous, they had crossed Indo-Pak border from Pakistan to Indian Territory un-authorizedly and armed with lethal weapons and ammunitions including AK-Rifles, Grenades with an assignment of creating terror in the state of J&K at the instance of Pak ISI and militant groups based there. Considering the totality of the circumstances, each of the accused is sentenced to undergo imprisonment for terms of 10 years to pay fine Rs 10,000 u/s 3 Enemy Agent Ordinance. Each of them is further sentenced to undergo imprisonment for terms of five years u/s 4/5 Explosive Substances Act. Accused are also sentenced to undergo imprisonment for a term of two years u/s 14 of Foreigners Act. However, the Court clarified that all the imprisonments shall run concurrently. According to the prosecution case on January 1, 1998, the police party of P/S Bishnah intercepted accused persons, who were found moving in suspicious circumstances, at Naka laid by the police Village Devli. During the course of investigation it was found that both the Pak Nationals had entered Indian Territory without passport. During the investigation and on the disclosure of accused Mohd Aslam recovery of two Ak-56 rifles, three Grenades, six Magazines, 180 rounds of AK-Rifles, three bombs and five PTD Pencils was made from a place identified by him. While on the disclosure of Manzoor Ahmed one Ak-56 Rifle with silencer, six magazines, 160 rounds of AK-56 Rifles, three Grenades, two Bombs, four detonators and five PTD Pencils were recovered. After completion of the investigation, a case u/s 3 EAO, 4/5 Explosive Substances Act and 14 Foreigners Act, was established against both the accused. |
