Jammu, May 24: In a petition filed by Crime Branch & Ors for setting aside the order of CJM Kathua by virtue of which the age of respondent herein has been determined as less than 16 years taking his date of birth as 23-10-2002 which has the effect of declaring him as juvenile and extending him the protection of the Jammu and Kashmir Juvenile Justice (Care and Protection of Children) Act, 2013, Justice Janak Raj Kotwal after hearing Sr. AAG HA Siddqui appearing for the State issued notice to the respondent.
While issuing notice, Justice Janak Raj Kotwal observed Apex Court by the order dated May 7, 2018 had ruled that no court shall entertain any petition pertaining to this case. While keeping this aspect of the matter open for consideration, the court issued notice to the respondents. |
