| HC quashes PDP leader’s detention under PSA | | | Early Times Reporter Jammu | Feb 16 Justice JP Singh of Jammu and Kashmir High Court, Jammu Wing, has quashed the detention of Abdul Rahim Shan, Zonal President PDP Gool, allegedly an over ground worker of HM, on technical ground and ordered that he be set to liberty forthwith. After hearing both the sides, Justice Singh observed that the District Magistrate has issued the detention order on the basis of dossier and other connecting documents which are stated to have been supplied by the Superintendent of Police Ramban. The record indicates that the petitioner was in custody when he had been ordered to be detained by the DM under PSA and that too without recording requisite satisfaction that the petitioner was likely to be released from custody and when so released would indulge in activities pre-judicial to the security of the State. Justice Singh further observed that absence of such satisfactory hints at the manner in which the power has been exercised by the District Magistrate demonstrates his complete non-application of mind. The detention order of the petitioner is found to be unwarranted and illegal as such quashed and he is ordered to be set to liberty forthwith, if not required in any other case. According to the detention order, Abdul Rahim Shan s/o Jamal Din r/o Salbala, Gool being the Zonal President PDP Gool was also working for a militant outfit Hizbul Mujahideen and remained in constant touch with the HM Divisional Commander Mushtaq Ali and Mohd Ashraf and number of other hardcore militants. He also remained in the association of dreaded Pakistani National having code name Qari. Since December 2006 and during this period, Shan was involved in number of militancy activities and on this ground District Magistrate Ramban detained him under PSA on July 27, 2007, which was challenged by the detune on various grounds.
