| Court rejects bail in JDA Complex double murder case | | | Early Times Reporter Jammu | Feb18 Principal Sessions Judge Jammu Mr. JR Kotwal today rejected bail application of accused Gandharb Singh, who is facing trial along with other accused in much publicized double murder case in JDA complex Jammu on April 24, 2001. This bail application has been filed by the accused Gandharb Singh, who along with Balwan Singh and others, are being tried for offences u/s 302/ 307/ 326/109/34 RPC. The charge against the accused persons are that on April 24, 2001, they committed murder of Pardeep Kumar and Khem Raj in JDA complex Jammu. All the three accused persons are under incarceration ever since their arrest. Principal Sessions Judge, after hearing Adv PN Raina appearing for the accused-applicant and Special PP Sunil Sethi with Adv Vishal Kapur appearing for the State, referred various law points and judgments and observed that position in law is thus clear that accused does not acquire an absolute right of release on bail only due to the long period of trial and thereby the infringement of his right to speedy trial. Trial of this case cannot be said to have been delayed to the extent of causing infringement of the fundamental right of speedy trial of the applicant or the other accused persons. After framing the charges on May 1, 2002 prosecution evidence has since been completed and it is the defense which is now leading the evidence and would mainly influence the future course of the action in the case. With these observations, the Court rejected the bail application in this much publicized case. JNF
