| Court acquits alleged militants facing trial for attacking Brigadier | | | Early Times Reporter Jammu |Feb 22
TADA/POTA/3rd Additional Sessions Judge Jammu Sanjay Gupta acquitted three alleged militants namely Amjad Khan Alias Munna, Mohd Sadiq Alias Kala r/o Ram Nagar Budhal and Raj Kumar Alias Raju r/o Toli Morh Chabti Tehsil Mahore who are facing trial in a case that they hurled two grenades at Brigadier and his protection party in which Brigadier and two sepoys were injured. A report was lodged with the police on April 19, 2004; the police registered a case u/s 307/ 120-B/ 121/ 122 RPC r/w 7/25 Arms Act and 3 PSS Act. Court after hearing both the sides observed that on careful consideration of whole evidence and surrounding circumstances as well as the case law authority cited by the defence counsel, it appears that evidence of prosecution witnesses are not inspiring confidence. The prosecution witnesses have failed to stand the test of reliability and rendered evidence of doubtful character. Prosecution has failed to prove the case against the accused beyond reasonable doubt, accordingly accused persons namely Amjad Khan Alias Munna, Mohd Sadiq Alias Kala r/o Ram Nagar Budhal and Raj Kumar Alias Raju r/o Toli Morh Chabti Tehsil Mahore are acquitted of the charges leveled against them.
