| HC directs forest dept to compensate | | | Early Times Reporter Jammu | Feb 22
In a writ petition Justice YP Nargotra of J&K High Court Jammu Wing directed the forest dept to accord consideration to the case of the petitioner and pass appropriate orders. According to the case of the petitioner Rameshwer Singh that his father provided land measuring 8 Kanals and 3 Marlas to the respondents free of costs for forest closure, on the assurance by some of the officials of the forest dept that employment would be given to the one of the family members in the forest dept. In the year 1994 petitioner was appointed as daily wager, after 3 years his services were terminated. The petitioner filed a petition in the year 1999 which was disposed of with a direction to the respondents to accord consideration to the case of the petitioner. The respondents consider the case of the petitioner and rejected the same vide order December 31, 2003 passed by the Chief Conservator of Forest Jammu. Justice YP Nargotra after hearing Adv ML Gupta appearing for the petitioner and AAG Mr. PC Sharma appearing for the forest dept observed that the contention of counsel for the petitioner that petitioner would be satisfied if respondents are directed to accord consideration to the case of the petitioner for payment of compensation in lieu of the land acquired by the respondents. AAG Mr. Sharma submitted that respondents would have no objection in examining the case of the petitioner and if on such examining it found that land has been acquired, compensation due shall be assessed and paid to him as per law. Court in view of the submissions made, the petitioner disposed of with the direction to the respondents to accord consideration to the case of the petitioner and passed appropriate orders within a period of four months from the date of a copy of this order along with documents in support of his claim are made available by the petitioner to the concerned authorities
