Nepotism, favouritism alleged in selection, Court issues notice to govt

Following allegations of favouritism and nepotism in selections of doctors in the department of Indian System of Medicines (ISM), the Jammu and Kashmir High Court has issued notice to the authorities and said that the select list will now be subject to the outcome of the writ challenging selections process.
It has been alleged by a petitioner that meritorious aspirants have been ignored while those having close relations with the Ministers and other influential peoples have been selected. The petitioner alleges that one of the selected candidate is son of the Rural Development Minister Mula Ram while other is daughter of the Public Relations Officer to Health Minister Mangat Ram Sharma.
Hearing the petition, Justice Mansoor Ahmed Mir issued notice to respondents through newspapers and in the meantime ordered that selection and appointment of 36 candidates shall be subject to the outcome of the writ petition.
In a writ petition filed by Dr. Sunil Kumar and others challenging the selection of 36 ISM doctors through Advocates Sudershan Sharma and Ashwani Khajuria it has been submitted that notification was issued for the selection of 35 posts of ISM and Homeopathic doctors specifically mentioning that for giving preference to the candidates residents of block where the health institution is located. This condition was kept only to ensure continuous presence of doctors and paramedic for 24 hours duty for whole of the week in the said institution whereas the private respondents have been selected and appointed at the cost of the petitioners who are more qualified and meritorious than the private respondents and also residence of Samba district.
During the course of arguments Adv Sudershan Sharma and Ashwani Khajuria appearing for the petitioners submitted that only 35 posts ISM doctors were advertised vide the notification, but the respondents have selected 36 candidates. The private respondent No 36 is the daughter of one of the member of selection/ interview committee. They further alleged that private respondent No 40 is the son of present cabinet minister for rural development Department, private respondent No 34 is the son of PRO of cabinet minister for health and medical education dept. It was alleged by the counsels appearing for the petitioners that respondents have selected the private respondents who were/ are their blue-eyed persons and none of the candidates have been selected from Samba District and by selecting the private respondents who are not residence of Samba District. The Govt respondents themselves violated the condition and terms contained in notification dated November 3, 2007 and seeking quashment of selection/ appointment of 36 ISM/ Homeopathic doctors.
