| Rape accused denied bail | | | Early Times Reporter Jammu | Feb 27 Special Municipal Mobile Magistrate, Jammu MS Parihar today rejected the application filed by the father of Romesh Singh of Uttam Nagar Bye-pass Jammu, involved in alleged rape and cheating case. According to the police case on February 2, 2008, the complainant lodged a written complaint with the police regarding the commission of offence of rape and cheating against the accused/applicant with the allegations that accused Romesh Singh has raped the prosecutrix with the understanding that he will marry her. The police on the basis of said written report registered case u/Ss 376/420 RPC and initiated the investigation. The accused has not been arrested by the police so far. The accused has absconded after the commission of alleged offence. Adv BR Chandan appearing for the accused stated that accused has recently married and in case of his arrest the reputation of the applicant will be lowered down in the society and on the other hand Jawaid Khawaja Senior Prosecuting Officer appearing for the police has vehemently opposed the bail application on the ground that accused is involved in a heinous crime and is evading his arrest and as such he is not entitled to bail. Court while deciding the bail application observed that the accused has not been arrested by the police and he is as per the police report evading his arrest. The application for bail has not been filed by the accused himself and he has also not appeared in the court. The application for bail is maintainable only when the accused has been arrested in a non-bail able offence. The accused has neither been arrested no appeared in the Court as such the application for grant of bail is dismissed. JNF |
