| HC quashes appointments of 4 teachers engaged under ReT scheme | | | Early Times Reporter Jammu | Feb 27 Justice Nirmal Singh of J&K High Court Jammu Wing has quashed the appointment of four private respondents who were appointed as teachers under Rehbra-e- Taleem scheme and directed the respondents to make appointments out of the panel already prepared for village Dalli. This significant judgment has been passed in a writ petition challenging the engagement of four private respondents who were engaged teachers under Rehbra-e-Taleem scheme. In the petition it has been submitted that in pursuance to an advertisement notice the petitioners applied for the same for being considered for engagement in the Govt Middle School Patiyari falling in Village Dalli, Tehsil Kalakote District Rajouri. The respondent prepared a panel and the names of the petitioners figured at serial No 3 and 5 in the said panel. The grievances of the petitioners is that the respondent authorities instead considering the claim of petitioners along with other eligible candidates whose names figured in the said panel, engaged private respondents No 5 to 8 as teachers in the Government Middle School Patiyari even though they belonged to a different village namely Dhalyote. It is stated that as per the scheme the engagement could be made from amongst the candidates who belong to the village where the vacancies existed in the school falling in the said village only. Justice Singh, after hearing Adv VR Wazir appearing for the petitioners and Deputy AG Neeru Goswami appearing for the State, observed that in the present case the vacancies existed in village Dalli. Even the panel was prepared from amongst the candidates belonging to the said village. But the respondents appointed private respondents who belonged to different village. Therefore, the appointment of private respondents can’t be sustained in terms of the scheme. The petition is allowed and the appointment of private respondents No 5 to 8 is quashed with a direction to respondents to make the engagement/ appointment out of the panel already prepared for village Dalli.
