| HC attaches salary head of Director RDD, ACD Ramban for non-compliance of order | | | Early Times Report
Jammu, Aug 20: In a significant order, Justice Janak Raj Kotwal of Jammu and Kashmir High Court (Jammu Wing) has directed Director Rural Development Jammu and Assistant Commissioner Development Ramban to clear outstanding liability before next date of hearing failing which salary head of Director RDD and ACD shall stand attached to the extent of their salary and their salary shall not be released till the liability is cleared or till further orders from the Court which ever may be earlier.
These Court directions were issued in a contempt petition filed by Nazir Ahmed Shah seeking initiation of contempt proceeding against the respondents for violating the directions of the court whereby directions were issued to consider the claims of the petitioner for the release of outstanding liability.
Advocate Irfaan appearing for the petitioner submitted that the petitioner was allotted construction of CFC building at Tethar Lower Banihal under scheme PMRP Model village in the year 2006 but the respondents failed to release the entire liability in favour of the petitioner despite completion of the work constraining the petitioners to knock the doors of the Court.
Advocate Irfaan further submitted that despite admitting the outstanding liability the same is not being released and not only this on 29.05.18 directions were issued to ACD Ramban to file fresh compliance and in default he had to appear in person and even that has not been complied.
After considering the submissions Justice Janak Raj Kotwal further directed both these officers and Treasury officer concerned shall ensure that this order is complied with. A.M.Malik Deputy Advocate General appeared for respondents. |
