| HC rejects bail of petitioner facing trial in abetment to suicide case | | | Early Times Reporter Jammu | Mar 6 Justice JP Singh of J&K High Court Jammu wing rejected the bail application filed by Souvik Chowdhury facing trial before the Court of Principal Sessions Judge LEH u/s 306 RPC (abetment to suicide). While rejecting the bail Court after hearing both the sides and gone through the police challan and statements recorded by the investigating agency during the investigation of the case observed that statement of some of the witnesses recorded during the investigation, does not indicate about petitioner's having treated his wife with cruelty. Plea of the counsel for the petitioner that investigating police officer had collected only hearsay evidence to involve the petitioner does not appear to be justified. In view of the evidence collected by the investigating agency, no fault can be found with the view taken by the Principal Sessions Judge LEH in refusing bail. In view of the material place on the records court do not find the petitioner to have succeeded in making out a case for his release on bail at this stage. The bail application is rejected, petitioner shall, however, enjoy liberty to move a fresh application before the Principal Sessions Judge LEH after the statements of the prosecution witnesses are recorded.
