TADA Court awards 20 yrs imprisonment in jail-break case

Presiding Officer, TADA/POTA/3rd Additional Sessions Judge, Jammu, Mr. Sanjay Gupta today awarded 20 years imprisonment to accused Zarar Bloach s/o Haji Saif-ul-Din r/o Khadi Baluchistan, who was facing trial along with other accused in jail-break case.
According to the police case on November 27, 1994 accused along with other accused while in custody in Kot-Bhalwal Jail made a plan to escape from the jail and carved out a tunnel in the jail to escape from lawful detention. When they were at the stage of accomplishment of the tunnel, the police came to know through reliable source about the plan and went to barracks to enquire about this activity. On the entry of these police officers, the accused attacked upon police personnel with iron rods and stones and deterred them from discharging their lawful duty. These police personnel got injured and a case U/Ss 149/120-B/147/148/332/336/337/224/511/307 RPC was registered.
While awarding the sentence, Presiding Office, rafter hearing APP Gulzar Singh Charak and accused, present in custody, observed that Court has carefully gone through the whole aspects of case. It is also a fact that other 3- Pak Nationals namely Nassar-Ullah, Ghulam Haider and Fahad-Ullah, facing trial, have already been convicted after confessing their guilt.
The accused Zarar Bloach has no doubt made voluntary confession to the guilt; therefore, in view of the confession made by him, the Court sentenced the accused to 10 years rigorous imprisonment and fine of Rs 1000 u/s 307 RPC, 2 years imprisonment u/s 224 RPC. The accused was also sentenced to 3 years imprisonment, u/s 332 RPC, 3 years imprisonment u/s 147 RPC and 2 year imprisonment u/s 353 RPC. Court ordered that all the sentences shall run concurrently.
