| Court acquits two accused facing trial in double murder case | | | Early Times Reporter Jammu | Mar 10 2nd Additional Sessions Judge, Jammu Mr. AK Koul today acquitted Mohammed Anwar and Mohammed Nasbul r/o Bihar, who were facing trial in a double murder case. Proceedings, against other accused Mohammed Akhter, husband of deceased Afsreen and father of deceased Nasreen, Mohammed Mazbul and Anju wife of Mohammed Mazbul r/o Bihar, who have been declared absconding, have been initiated u/s 512 Cr PC. While acquitting both the co-accused, 2nd Additional Sessions Judge, after hearing APP for the state and Adv Prince Khanna appearing for the both the accused, observed that the entire evidence on record is only hearsay and court do not find a single incriminating circumstances existing on record against both the accused. If there is any evidence on record, it is only against absconding accused. So far these two accused are concerned there is nothing on record to show their complicity directly or indirectly in the commission of crime. One of the peculiarities of the case is that the investigation has also been conducted in a very casual manner and it is astonishing to note that IO has gone on the spot after almost five months. So, this is probably one of the reasons that the best evidence could not be collected which could unfold the mystery surrounding the death of the deceased. The entire exercise conducted by investigating agency and prosecution is that the guilt has not been brought whom to both the accused and they are acquitted of the charges. They are in custody; they shall be set-free provided they are not involved in any other case, the Sessions Judge ordered. According to the police case on March 12, 2005 a source report was received in P/S Channi-Himmat Jammu that the dead-body of a woman was lying in Jugi bye-pass in suspicious circumstances. The IO proceeded to the spot and found the dead body of Afsreen w/o Mohd Akhter and Nasreen daughter of Mohd Akhter lying on spot. The dead-bodies were shifted for post-mortem and the Viscera were forwarded to FSL Jammu for expert opinion. According to the post-mortem report the death of both deceased was due to poisoning and while the process of investigation was going on, an application of one Mohd Sarwar was received from the office of IGP in which serious allegations was leveled against accused Mohd Akhter. According to Mohd Sarwar the deceased Afsareen was one of his sisters and she was married with accused Mohd Akhter in the year 1994. They had two children. Deceased and accused Akhter lived together peacefully for one and a half year and thereafter accused started ill-treating the deceased because accused developed illicit relations with some other women. Deceased filed a case against accused Akhter under Dowry Act and Akhter was convicted in that case. At the same time, Akhter kidnapped the deceased and brought her to Jammu. The witness came to know about the murder of deceased. |
