| Accused convicted to 5 yrs SI after 23 yrs trial in misappropriation case | | | Early Times Reporter Kathua | Mar 11 Convicting accused to five years simple imprisonment and a fine of Rs.2000 for misappropriating government money in agriculture department, the Chief Judicial Magistrate Kathua B S Bhou observed that the prosecution has been able to prove the charges against the accused Avtar Krishan Trisal s/o Ved Lal Trisal of Kathua, a government employee. In his 36 page judgment, CJM said that the prosecution has established that the accused was entrusted money on different dates by different employees of the District Agriculture Office Kathua on different counts and the accused misappropriated the same. He said the charges against the accused of having misappropriated Rs.57716. 17 have been established beyond any shadow of doubt. The CJM while pronouncing his judgment in the case, which was pending since last 23 years, after hearing CPO Ravinder Rao and defence council Arvind Gupta, held the accused guilty for commission of offence u/s 409 RPC and sentenced him to undergo simple imprisonment of five years, besides a fine of Rs.2000. In default of payment of fine, the accused shall further undergo simple imprisonment of six months, the CJM ordered. The police on a written complaint made by the district agriculture office Kathua on March 24, 1983 took up investigation and on completion of the same presented a challan in the court of law on November 12, 1983. However, the CJM on March 15, 1984 returned the original challan to the Senior Prosecuting Officer for bifurcating the same in terms of section 234 Cr. PC . Thereafter, on August 26, 1985, 14 cases were presented against the accused for misappropriating government money within a period of one year, as a government servant then, and sent the accused to stand trial. After framing charges against the accused on February 1, 1986 prosecution led evidence and recorded the statement of the accused under section 342 Cr PC. |
