HC takes serious note of the functioning of state respondents

Justice YP Nargotra of J&K High Court Jammu Wing in a petition in which the Court on March 28, 2005 stayed the suspension order of Naib-Tehsildar (petitioner), has dismissed the petition in default and took serious note of the functioning of the respondents. The Court observed that from the perusal of the order sheet, it transpires that petitioner has not taken steps for service of the respondents till date, except obtaining stay order; this all obviously is deliberate and planned option. Anyway one thing is sure that the petitioner has taken stay order for producing the same before the respondents and respondents too unfortunately did not bother to approach this court by filling their stand in the shape of objections or any application for vacation of stay.
Today when the case was called neither petitioner nor his counsel had appeared. In this situation, this writ petition is dismissed in default of appearance and for non-prosecution. Interim direction of March 28, 2005 is vacated. Registry is directed to send a copy of this order to the Financial Commissioner (Revenue) and also to Divisional Commissioner for information, Justice Nargotra ordered.
This court direction has been passed in a petition filed by Jagbir Singh then Naib-Tehsildar Digiana, who was placed under suspension on March 18, 2005 and challenged the same in the High Court on March 28, 2005. High Court issued notice with the direction that list immediately after service is complete, petitioner to take steps for service of the respondents. Meanwhile till next date of hearing and subject to objections of the other side order dated March 18, 2005 shall remain stayed if not already implemented. It is worthwhile to mention here the respondents from March, 2005 have not filed any objection and Court take serious note of functioning of the State functionaries.
