| Court rejects bail application of husband involved in cruelty | | | Early Times Reporter Jammu | Mar 15 Special Municipal Magistrate, Jammu, Mr. MS Parihar rejected the bail application of Sandeep Singh s/o Angrez Singh r/o Tareband Barwal, Kathua, against whom his wife had lodged a complaint with the CJM Jammu. The complaint was sent to SHO Women’s Police Station Jammu for action which registered a case u/s 498-A and 109 RPC. The accused Sandeep Singh had filed bail application through Adv Rakesh Singh for grant of bail. Court called the report from the concerned police station which was submitted by SPO Jawaid Ahmed Khawaja who also filed objection in the bail application. In his objection, Senior PO contested the bail of the accused. Special Municipal Magistrate, after hearing both the sides and also perusing the bail application and case dairy produced by the SPO, observed that that a complaint was filed by the wife of accused before the CJM Jammu and the said complaint was transferred to the court of Special Excise Magistrate Jammu for disposal under law. On the receipt of the said complaint SHO P/S Women Cell registered a case u/s 498-A/109 RPC against the accused and his family members. The other five accused had been admitted bail by the City Judge Jammu by surrendering before the said Court but the accused had also filed an application for bail which was dismissed as he had not appeared in the said court. Accused Sandeep Singh filed this application for bail but he has not appeared in this Court on the date of filling of application on or thereafter. The accused Sandeep Singh, as is evident from the police report, has not been arrested so far and the application for bail is maintainable only when the accused has been arrested by the police or he has appeared in the Court. With these observations, Court dismissed the bail application. JNF |
