| DB issues notice to Union of India, Ors in PIL | | | Early Times Reporter

Division Bench of J&K High Court Jammu Wing, comprising Chief Justice KS Radhakrishnan and First Puisne Judge Nisar Ahmed Kakru, in a PIL issued notice to Union of India through Secretary, Ministry of Health & Family Welfare New-Delhi, State of J&K through Commissioner-cum-Secretary Health and Medical Education and Commissioner-cum-Secretary Law Dept.
DB also directed Adv Anil Sethi to provide copy of the petition with all annexures to Deputy AG and list the case after three weeks.
Amit Chouhan petitioner, claiming to be a social activist, filed the PIL in the larger interest of the public seeking implementation of prohibition of advertisement and regulation of trade and commerce production supply and distribution Act on cigarettes and other tobacco products.
The petitioner submitted that it is not known as to why a duly passed law is yet to be implemented on ground. It is perhaps the pressure of Tobacco lobby and corresponding revenue that it generates for the Government that legislation enacted by the law is being ignored and not being implemented. The petition seeks directions to the respondents and all concerned enforcement agencies for taking immediate meaningful and concreted measures to implement the provisions of cigarettes and other tobacco products Act and Rules.
