| HC issues notice to Government on MLA’s petition | | ‘Seeks quashment of FIR’ | | Early Times Reporter Jammu | Mar 17 Justice Virender Singh of J&K High Court Jammu Wing today issued notice to Commissioner/ Secretary Home, DIG Police Jammu Range, SSP Security, SHO P/S Domana and Incharge Police Post Sandwan in a petition filed by Faqir Nath MLA Jammu and Kashmir National Panthers Party against whom a case u/s 353/332/147 RPC has been registered in P/S Domana on March 10, 2008 for allegedly beating the police guard of MLA. In the petition Adv BB Kotwal, Adv HC Jalmeria and Adv Bansi Lal appeared for the MLA and submitted that the Senior Police Officers of the State who were responsible for barbaric and criminal attack on JKNPP leaders at Katra on August 7, 2007, in which Anita Thakur, PK Ganjoo were barbarically thrashed and beaten whereas leg of HC Jalmeria was broken are facing the case in the Supreme Court of India. The Government and police administration is hell-bent to wreck vengeance against the JKNPP leadership. They are making one or the other concocted case against the workers and leaders of the Panther Party to intimidate and harass them so as to prevent them from performing their legal and constitutional duty to raise the voice of the common people of the state in and out side the Assembly. In the petition it has been submitted that on March 9, 2008 at about 10 PM when the petitioner who was at the first floor of his house, came to know that some stranger was sleeping on his bed at the ground floor, the petitioner came down an enquired about the identity of the person. The stranger, instead of disclosing his identity pushed the petitioner with the result, the petitioner fell down. The PSO of the petitioner Ashok Kumar intervened and rescued him. In the meanwhile, people from locality also reached there. The petitioner called the police from the police post Sandwan and took the stranger away. To a great surprise of the petitioner, news was published in the newspapers that MLA Faqir Nath (petitioner) had been booked by the police. On enquiry the petitioner came to know that a false and fabricated case has been registered against him and his family members by the police on the complaint of some Sukhdev Singh and sought quashment of the FIR registered against the petitioner and his family members.
