Student gets lifer for killing principal

After nine years of the brutal incident in a Gandhi Nagar school, a local Court has awarded life term to the student who had killed his principal in the school premises.
Second Additional Sessions Judge Jammu AK Koul today awarded life-imprisonment to accused Harjeet Singh of Lower Gadi-Garh who killed Principal KK Badyal in the Broad-day light in the school premises.
According to the prosecution case, on February 3, 1999 a written report was lodged by Rajinder Singh then Vice-Principal of Govt Higher Secondary School Gandhi Nagar Jammu that at about 1115 AM two Sikh youths approached him while he was delivering a lecture to the student and asked him to issue a certificate that accused Deep Inder Singh had performed required number practical in physics and chemistry class 12. He told them to approach the board for necessary permission on the application of accused Deep Inder Singh.
At about 1:35 PM same youth again approached the principal of the school in his office chamber with the same demand. There was a heated exchange of words between them. After a short while accused Harjeet Singh marked his presence on spot again with sharp edged weapons and attacked the principal who fell unconscious and was shifted to GMC where declared dead. A case u/s 302/333/452/34 RPC r/w section 4/25 Arms Act was registered and after completion of investigation challan was presented.
2nd Additional Sessions Judge Jammu Mr. AK Koul after hearing APP Mr. Ravinder Sharma appearing for the State and Adv SC Bali appearing for the accused Harjeet Singh and Adv Sunil Sethi appearing for the accused Deep Inder Singh, Court convicted accused Harjeet Singh and acquitted accused Deep Inder Singh and on the quantum of punishment sentence Court observed that in the present case the crime committed by the accused and the manner in which it was committed suggest that accused committed the crime in a very gruesome manner and so ordinarily the accused deserved maximum punishment prescribed for the Crime but in India the general rule in cases of murder, is life-imprisonment while as death is an exception. Although the act of the accused was in human and barbaric but still court believe that it cannot be designated as rarest of the rare case. The age of the accused, the time span consumed in the trial, the domestic condition of the accused are some mitigating factors which have to be considered objectively to decide the quantum of punishment and awarded life-imprisonment and fine Rs 5000/- u/s 302 RPC.
