SC to hear petition to shift sex scandal case outside J-K
8/28/2006 12:13:56 AM
New Delhi | AugUST 27
A week after the Supreme Court put brakes on indiscriminate arrests in the Srinagar sex scandal, thirteen out of the 14 accused, arrested by the CBI, have moved a petition before it seeking shifting of the case to a place outside Jammu and Kashmir.
In the petition, which has been listed for hearing tomorrow before a Bench headed by Chief Justice Y K Sabharwal, the accused have contended that it was not possible for them to get free and fair trial in the prevailing situation in the state as no lawyer was willing take up their case in the wake of a resolution passed passed by Jammu and Kashmir Bar Association in Srinagar. Except former Congress Minister Ghulam Mohammed Mir, all other accused are seeking transfer of the trial to a place outside the state. In the petition filed through advocate Vikas Mehta, the accused have also sought bail.
Meanwhile, the apex court is also expected to examine the records and case diary which were placed before the Jammu and Kashmir High Court for monitoring the case.
