| DB orders status-quo on promotion of SE as I/C CE PDD | | | Early Times Reporter

Division Bench of J&K High Court Srinagar Wing comprising Chief Justice KS Radhakrishnan and First Puisne Judge Nisar Ahmed Kakru in an appeal filed by Sonam Gailson and Ors presently Incharge SE in the PDD against the judgment of Single Judge passed on September 10, 2007, ordered ‘status quo be maintained for a period of one month’
The HC issued this order after hearing Deputy AG M A Beigh appearing for the State, Sr. Adv DC Raina and Sr. Adv ZA shah with Adv Moksha Kazmi appearing for the petitioners whereas Adv Shah Amir appearing for the respondents,
It has been submitted in the appeal that while writ Court allowing the appeal filed by Abdul Rashid, Tariq Masood Shah, Mustaq Ahmed Shah, Manzoor Ahmed Salroo and Gul Ayaz, issued direction to the State for regularization of Executive Engineer/ Superintending Engineer for promotion as Chief Engineer on Incharge basis and the petitioners be treated as senior to private respondents namely Sonam Gailson, Asgar Ali and Chering Dorjey. The appeal maintained that the appellants belonging to reserved category of ST have protection under the Constitution of J&K as well as under the Constitution of India. The appellants were at the relevant point of time holding the post of Incharge SE and were in the pipe-line for being promoted as Chief Engineer and pointed out that candidate belonging to General category can catch up his position and can be declared senior to the candidates belong to reserved categories and prayed for setting aside the judgment and order dated September 10, 2007 passed by the Single Judge in a petition filed by the Abdul Rashid and ors.
