Illogical, Pak and its valley based lobby claim over
J&K State without any arguments and facts
A N Bharadwaj11/18/2018 8:17:44 PM
The President, International Human Rights Protection Council expressed in deep sorrow on the venomous statement issued by the Pak foreign office, spokesperson, Taslim Aslam on the issue of J&K, appeared in the media dated 7th July 2014, that it was a disputed territory to mislead the people that her statement was baseless and fictitious. To propagate the state disputed territory on whimsically without any arguments either legally or historically and uttering like parrot, even then its legal and political status cannot be changed only by deceptive propaganda. Pak did never insisted to include so called disputed territory issue in two nation agenda held in the past for so many times. It has been merely misleading propaganda for vote bank at the cost of creating communal wedge. On the basis of ground realities, it appears that soon after the accession to India of the State Jammu & Kashmir, Pak forces and its patronized rally of tribal raiders by violating standstill agreement, made with the ruler of the State, crossed international border, which was the breach of trust, intruded cyclonically in the border of India by committing en masse killing of bordering people and heart breaking bloodshed resulting in encroaching upon 1/3rd Indian State territory.
Keeping in view of an unending blood spilling India knocked the door of the UN Security Council and submitted a representation having informed the Pak committing an aggression over the Indian State of Jammu and Kashmir and encroaching upon its State territory and requested to get it stopped further bloodshed and the territory surrendered occupied illegally. Afterwards pt. Nehru informed to the nation that they had more military power than Pakistan, but his conscience had not allowed him to kill those with whom they and their for furthers had been living since centuries under the policy of non-violence which they followed.
Thus the UN Security Council immediately declared cease-fire and encroached upon the State territory as status quo till further order and out it under Pak to keep its status intact. During process its resolution it asked Pak to vacate the Indian State territory encroached upon illegally for plebiscite to provide congenial atmosphere but it evaded. It is not a disputed territory at all as nothing sort of any indication is available in any record. So much so, when the case was being dismissed, Pak representative Sir Feroze Khan Noon, who had been pleading the case in UN Security council on behalf of Pakistan, prayed to give him last chance for the argument to plead the case, after allowing, he told that his country claimed over Kashmir was based entirely on the argument that Kashmir was a Muslim majority territory that under the British India partition arrangement Muslim majority area if that was contiguous should go to Pakistan automatically but his argument was rejected and fell flat on the ground that Indian nationalism had never accepted two nation theory, that has being pleaded secularism. If was informed that his Majestry Government desired that the decision announced related to only British India and its policy towards British Indian States continued in the Cabinet Mission memorandum of 12th May 1946, remained unchanged. Thus Pakistan had being helpless to submit any more argument to justify its plea, but despite, the UN Security Council told clearly in its resolution dated August 1948 and January 1949, announced that the responsibility for the security of Kashmir rested with Government of India, besides admitting State sovereignty over India shall not be brought into question, and there shall be no recognition of the so called Azad Kashmir Government at any time, as well as that territory of Kashmir controlled by Pakistan shall not be consolidated.
Pakistan had been kept silent and evaded to withdraw its forces from the illegal occupied territory of the State. Apart from its highhandedness, it took misadventure to cede Indian State occupied territory to China, while he had no sovereign power, as well as illegal immigration of alien of Sunni sect to settle in northern areas for demographic change and uprooted the indigenous people belonging to Shia sect, besides other violations relating to altering its status quo for the construction of air-fields and Bashan Dam etc, for which it is answerable.
The UN Security Council during contesting the case found that Pak had invaded of the State and admitted by the Pakistan also that it took aggression over the J&K State. It was branded an aggressor country. Pak had not found any justify ground to stake its claim over on the state. Afterwards the Pakistan proposed to India to talk mutually and bilaterally for the involvement of mutual difference, whatever may be. Thereafter India invited Pakistan at Simla in 1972 wherein it was decided under Government stamp that we ourselves would decide issue bilaterally and mutually without any mediator or any third party interference and the status of the case was declared as bilateral issue. In that sweet atmosphere, on the request of Pakistan 93-war prisoners were released by India, and cease fire line was declared line of actual control and other facilities as desired by it, were granted and further decided to convene next meeting to discuss the issue but no issue was raised in the two nation meeting held for so many times. However, India despite protests and representations raised the issue to surrender the grabbed State territory; so much so the parliament of India one after other passed resolutions to ask Pakistan inform the mode of surrender the territory in question, but no heel was paid by it. Thus the matter in lying pending.
It was known to Pakistan, that it had neither legal or historical facts to justify their demand, therefore it would exceed with its muscle power to prick India and started terrorism in the name of religion to incite the Kashmiri Muslims for subversive activities, killings and bloodshed which all highhandedness sims and crimes were passed on India and its force, to malign them gruesome human rights violations. It was its strategy to make the pot boiling for unrest, chaos, instability, shutdown, strikes interference to paralyze the State Government. For that purpose it has established its stipendiary lobby in the valley which working to implement its Pak agenda by misleading the people. The National Investigation Agency during terror funding case received information them for unrest, holocaust, spilling blood and paralyze the administrative system, removed the mask from their faces who are Indian citizens but working for Pak cause in the valley of the State who are facing judicial cases under liberal policy of the Government of India. Taslim Aslam, Foreign office spokes person may go for study of the Jammu and Kashmir State before uttering any comment against India.
