| Petition seeking quashment of FIR partly allowed | | ‘Recovery of antique coins’ | | Early Times Reporter Jammu | Mar 31 Partly allowing petition seeking quashment of FIR for possessing Antique Coins, Justice JP Singh of Jammu and Kashmir High Court observed that possession of coins by the petitioner may not amount to commission of any offence under the Antiquities and Art Treasuries Act of 1972. The power of the police to investigate other allegations that an inter-state group was involved in hatching a criminal conspiracy to steal monuments of Archaeological importance from different places and sell these to tourists and others, cannot be said to be an abuse of the process of law, Justice Singh further observed. These observations were made by Justice Singh in a petition seeking quashment of FIR for possessing antique coins. Justice Singh after hearing both the sides observed that Court do not find any ground to quash the FIR as whole and specific it would be that FIR registered against the petitioner u/s 25/08 of Antiquities and Art Treasury Act 1972 was uncalled for because section 8 prescribes for grant of license and does not make violation of any of the provisions punishable under the said Act. Following recovery of number of coins belonging to British period with sculpture and work of various languages with Lord Buddha sculptures, one silver ring with ‘Alla-ho-Akbar’ and Mohd ‘Sullah-ho-Allahiwasalm’ words, one medal having one side Ashoka and other side independent anniversary, a case u/s 379, 380 and 120-B RPC was registered for investigation.
