| Court awards 15 yrs imprisonment to Pak National an ISI agent | | | Early Times Reporter Jammu | Apr 1 1st Additional Sessions Judge Jammu Mr. Puneet Gupta today awarded 15 years sentence to accused Mohd Ajmal Chouhan code name Afria Sherkhan s/o Abdul Rehman r/o Atwaal, Tehsil Shakergarh, District Narwal, Pakistan who was arrested by the Samba Police in the year 1999, while he was crossed the Indian Territory without valid documents. During the course of investigation it has been alleged that accused Mohd Ajmal Chouhan is an agent of ISI and on his disclosure one AK-56 Rifle with one Magazine and 30 live cartridges were recovered and a case was registered u/s 7/25 Arms Act, 6/14 Foreigners Act and 3/12 Indian Passport Act . After completion of the investigation, challan was presented in the Court of Law. Ist Additional Sessions Judge, after hearing APP Harpal Singh and Adv Dinesh Amicus Curie for the accused and accused produced in custody and after recording his statement observed that it appears from the case that accused is guilty for the commission of offence u/s 7/25 Arms Act r/w section 6/14 Foreigners Act and 3/12 Indian Passport Act. The accused is in custody for the last more than 8 ½ years and is convicted and sentenced u/s 7/25 Arms Act for the period he has already remain in custody. The accused is also convicted u/s 6/14 Foreigners Act and sentenced for a period of 5 years. The accused is also sentenced u/s 3/12 Indian Passport Act for a period of 2 years. Court, while awarding sentence, observed that the accused who is in custody for the last more than 8 ½ yrs, shall be deemed to have served sentences in both the offences. The accused Mohd Ajmal Chouhan shall be set at liberty in case he is not required in any other case or proceedings. JNF |
