2nd Additional Districts and Sessions Judge Jammu Mr. AK Koul today recorded statement of Pt. Mangat Ram Sharma, presently Health and Medical Education Minister, who appeared in the Court in a complaint filed u/s 500 (defamation) RPC against Shameshar Singh Manhas and Bali Bhagat both General Secretaries of J&K Bhartiya Janta Party and reserved the order.
The Government had appointed BS Salathia AAG and Adv RK Kotwal as Special Public Prosecutors vide notification SRO 20 dated January 16, 2008 and SRO 30 January 24, 2008 to file a petition against Shameshar Singh Manhas and Bali Bhagat General Secretaries BJP for written letter containing defamatory imputations which has been published in the number of newspapers against Minister for Health and Medical Education, Labour and Employment and Ladakh Affairs Department..
In the complaint it has been mentioned that while holding the press conference on October 3, 2007, the alleged accused persons namely Shamsher Singh Manhas and Bali Bhagat General Secretaries BJP made written and oral defamatory statements against complainant Pt Mangat Ram Sharma which was highlighted in print/electronic media. This was intentionally done by the alleged accused knowing that such imputations were bound to harm the reputation of the complainant. The alleged accused also started character assassination campaign of complainant by making willful and reckless denigrating and defamatory imputation publicity and prayed for initiating process against the alleged accused persons and on establishing the charge, they be convicted and sentence under law.
