Court granted bail to lady allegedly involved in terrorist activities

Jammu, August, 28:- Principal Sessions Judge Jammu Mr. Subhash Chander Gupta has granted bail to Khamida Bi w/o Safeer Ahmed r/o Kerni Poonch, who is involved in Enemy Agents Ordinance, has directed to release the accused petitioner provided she furnishes surety and personal bond to the tune of Rs 50,000/- each with the direction that she will not leave the jurisdiction of this Court refrain from moving along line of control.



While granting bail to Khamida Bi who is facing trial u/s 3 of Enemy Agent Ordinance after hearing Advocate BL Chatha and Public Prosecutor Mr. EA Tak and also gone through the statement of most important witnesses of the Challan, husband of the accused petitioner, who is alleged to have been called by the Army when accused was caught red-handed in possession of a wireless set and has been seen the accused at the post on his enquiry, his wife told him that she had gone to her son-in-law Mohd Hussain a terrorist, who had delivered her a wireless set for delivering of the same at Surankote and while going through the post her luggage was checked and wireless seized from her possession. This key witness of the prosecution before the Court has denied all the allegations categorically and stated that no wireless set was recovered from the possession of his wife nor he has seen any wireless set at the time of his calling at the army post. He has also denied that Mohd Hussain is his son-in-law.



Court while grating bail observed that Court is of the opinion that a case for bail is made out in favour of accused as the statements of all the witnesses recorded in the Court and the statements of the witnesses recorded u/s 161 CrPC, whose statements are yet to be recorded in the Court and directed to release the accused on bail provided she furnishes surety and personal bond to the tune of Rs 50,000/-.
