7 acquitted after 17 years trial

In yet another case of alleged corruption, the court acquitted accused after a prolonged trial of 17 years as nothing could substantiate the charges of Vigilance Organisation.
Special Judge Anticorruption Jammu Kartar Singh discharged then General Manager Cooperative Society Bishnah, Tehsildar, Assistant Registrar Cooperative and four private accused who were allegedly involved in the case of sale and purchase of Rattna rice which was then fixed rate by JAKFED of 440 per quintal but the Bishnah Cooperative sold 1500 quintals of Rattna rice to favorite firm at Rs 330 per quintal The different of Rs 1.50 lacs was allegedly shared between the firm and the delinquent officers. The Vigilance Organisation had initiated an enquiry in the year 1991.
According to the Vigilance case that cooperative society Bishnah was managed by the Committee appointed by Govt on November 20, 1984. according to the notification, the Tehsildar Bishnah appointed as Chairman, Agriculture Extension Officer Bishnah Member and Assistant Registrar Cooperative Society appointed as Member Secretary to manage the affairs of a society for a period of one year or till fresh elections are held. During the course of investigation it has been found that no elections of Cooperative Marketing Society Bishnah were held till 1992. The said officers including General Manager of Society procured 2236.43 quintals of paddy during the year 1990-91 @ Rs 215 per quintal for an amount of Rs 4, 80, 032.45 and sold the basmati at lower rate as fixed by JAKFED.
Special Judge Anticorruption after hearing both the sides and perused the record of the case observed that the meeting of the members of the society convened on May 2, 1991 and it was decided that there was fall of the sale price and no body was ready to purchase the rice at the rate of Rs 380 per quintal as wholesale rate. It was further decided in the meeting that because the raining season was about to start and as such there was chances of damage to the rice stored in the Godown and there was apprehension of damaged caused to it by the rates in summer season. So it was unanimously decided to sell the rice at the rate of Rs 360 per quintal at whole sale rate. However, retail of Rs 400 per quintal was continued. There is clear from the minutes of the meeting of dated May 2, 1991 recorded in the register maintain by the society.
This also goes to prove the bonafides of the official accused that they took all the factors into consideration while increasing and decreasing the rates of selling the rice. Court after considering all the facts and discharged the accused namely Rajinder Singh Jamwal then GM, KUldeep Kumar then Assistant Registrar Cooperative member secretary, the Tehsildar Harbans Lal then Chairman of the society now retired as Settlement Commissioner and private accused Vijay Kumar Gupta, Vishwanath, Arun Kumar Gupta and Kuldeep Chander Gupta all are residents of Bishanah as the VOJ failed to established its case against the accused persons.
