| Court discharges 5 accused at stage of framing charges | | Alleged false claim of vehicle from two insurance companies | | Early Times Reporter Jammu | Apr 14 Special Judge Anticorruption, Jammu, Mr. Kartar Singh discharged five accused at the stage of framing charges as no prima-facie evidence was established for the commission of offence u/s 120-B,420,467,468, 471 RPC and section 5(I) (d) r/w 5(2) of Jammu and Kashmir Prevention of Corruption Act 2006 by the accused persons namely Jaswinder Singh Development Officer National Insurance Company, Pavez Ahmed of District Budgam, Ghulam Mohd Peer, Harminder Singh Mehta and Channi Singh. The CBI in its challan presented in the court of Special Judge Anti Corruption had alleged that accused persons were party to a criminal conspiracy to cheat the insurances company by way of claiming false insurance claim of Tata-Sumo from New India Assurance Company and National Insurance Company. Special Judge Anticorruption, after hearing Sr. PP CBI and Advocates SC Bali, SDS Saini and Virender Bhat, observed that the prosecution case against Ghulam Mohd Peer and Harminder Singh Mehta is that the vehicle was not in existence and they forged and fabricated survey reports in order to give wrongful benefit to accused Parvez Ahmed and cause wrongful loss to the Insurance Company. These allegations of the CBI are not well-founded. In this connection a report No 22 dated May 2, 2002 at the PP Nehru Park Srinagar was mentioned that Abdul Ahad ASI stated that on reaching turn No 2 and Shankarachyara hills, one TATA SUMO and Maruti Van collided with each other and both the vehicles were badly damaged as such the prosecution had failed to establish that there was any criminal conspiracy among the accused to get false insurance claim of the vehicle. Court further said that had it been so, the officials of the police post Nehru Park Srinagar would have been party to it and allegations against Channi Singh are that he purchased said vehicle from Parvez Ahmed. Though it was not road worthy and lodged a false report of his theft in order to cheat the insurance company by getting the insurance claim. These allegations have also not been proved as stated that the vehicle was road worthy and that is why it was purchased by Channi Singh and brought to Jammu and got registration in his name. The staff of RTO checked the vehicle and there was nothing fishy in the matter and actually the vehicle of Channi Singh was stolen and after thorough verification the officials of the insurance company passed the claim in favour of Channi Singh. The Anticorruption Court observed since it is not a fit case to frame charges against the accused persons hence they are discharged from the alleged offences. JNF |
