| State Commission imposes Rs.50000 fine on Superintendent Post Offices | | ’Willful, negligent delay causes physical, mental trauma to appellant’ | | Early Times Reporter Jammu | Apr 16 In a significant judgment of public importance, the State Consumer Commission has awarded damages to the tune of Rs.50, 000 along with Rs.5000 as litigation charges for negligent conduct of the Postal authorities which is actionable under the Consumer Protection Act. Taking serious note of the willful and inordinate delay caused due to negligent conduct of the dealing officials of the Central Post and Telegraph Office here, the Commission observed that the delayed receipt of the application form caused heavily to Amit Verma who had to appear in the second stage course of Civil Service Examination which was being held by the UPSC at Delhi on October 21, 2005. The requisite form was delivered to the appellant after a delay of 11 days as a result of which he could not appear in the said examination. After discussing the legal principles at length, the State Commission headed by Retired Justice G D Sharma dispelled all the defences which were being raised on behalf of the postal authorities and held that 11 days delay was willful and it was a fault and imperfection in rendering the service which fell outside the ambit of the statutory protection guaranteed under Section 6 of the Post Office Act to the postal authorities. The Commission imposed penalty of Rs. 50,000 along with cost of Rs 5000 as litigation charges on the Senior Superintendent Post Offices, Jammu and sub post master HSG II, Kandoli Nagrota Jammu and directed the amount be paid to the appellant who had to undergo physical and mental trauma and spend unnecessarily for getting his form deposited personally at New Delhi. |
