Jammu | Apr 16
Sub Judge/ Special Mobile Magistrate Electricity Jammu Mr. MK Sharma today rejected the bail application of Ashwani Kumar alias Kali r/o Rajiv Nagar Jammu, who was arrested by Bahu-Fort Police in a rape case and kidnapping of a minor girl.
Special Mobile Magistrate, after hearing both the sides observed that in the present case the accused has been charged for the commission of offence u/s 363/366-A/376/201 RPC. The offences are serious in nature whereas offence u/s 376 RPC is punishable with imprisonment not less than seven years which may extend to 10 years and also be liable to fine. The victim is 16 year’s old and has a long to go in her life and such like offences leave a permanent mark in the memory of the victim. The offences against the women are on rise and concession of bail in such like offences results in encouragement to perpetrators of the crime. It shall therefore be in the interest of public and society not to grant bail to the accused and hence the bail application is dismissed. JNF
