| Court acquits AEO Industry, others after 10 yrs investigation | | VOJ miserably fails to prove its case | | Early Times Reporter

Special Judge Anticorruption Jammu Mr. Kartar Singh acquitted Rajesh Parihan AEO DIC Jammu, Arun Kumar Gupta and Kuldeep Singh partners Real Energy Systems after 10 years trial and investigation as Vigilance organization miserably failed to prove that the unit was not existent and was got fraudulently registered on the basis of false report given by AEO DIC Jammu.
According to the vigilance case the allegations against the accused are that Rajesh Parihan AEO DIC Jammu hatched a criminal conspiracy with accused Kuldeep Singh and Arun Kumar Gupta and by misuse of official position a bogus unit not otherwise qualified for registration was got registered under the name of M/S Real Energy System as SSI Unit by fraudulent unit deceitful means in order to get supply order as well as price preference from JAKEDA for solar domestic lights and accused Arun Kumar Gupta further conspired with the members of the purchase committee of SDLs and supply order in their favour for supply of 200 SDLs in the year 1997 @ Rs 13450 which was later on reduced to Rs 13400 per unit giving them price preference as SSI unit to which they were not entitled as the unit was non-existent and the SDLs supplied to JAKEDA were procured from M/S Renewable Energy System Hyderabad in finished form as the material supplied said bogus unit was not as per the specification of NIT but payments were release in its favour on fictitious certificates and after completion of the investigation challan was presented in the Court.
Special Judge Anticorruption after hearing both sides and going through the statements of witnesses referred the statements of the then General Manager DIC Jammu, according to which the papers of the real energy system were put up before him for registration. The said unit assembling and manufacturing solar lights was provisionally registered in the year 1996 and had started unit in a rented accommodation at Bari-Brahamana the said unit was inspected by Rajesh Parihan as also the rent-deed and thereafter submitted the report for permanent registration which was granted to unit.
Court also referred the statement of Nirmal Singh then DySP VOJ who had investigated the case. His statement is very material for the disposal of this case, he had tried to prove that the unit of the accused was not assembling unit but it supply finished products. He has further stated that he seized invoice and challan by which Renewal Energy System Hyderabad and had sent 200 complete solar domestic lights to Real Energy system Jammu. If this part of statement of DYSP is to be believed, he tried to prove that the SDLs were not assembled by the unit at Jammu but they from Hyderabad to supply to JAKEDA, in this way, they fraudulently got the price preference. However in the cross examination he has proved the fact that complete SDLs were not supplied to Real Energy system but its components and they were assembled at Jammu. In view of the said statements Court held that Vigilance has miserably failed to prove that the unit of the private accused was non existent and it was got fraudulently registered on the basis of false report given by the AEO, the IO himself demolished the prosecution story as such the Court is left with no alternative except to acquit the accused as such the accused are acquitted of charges framed against them.
