| VOJ miserably fails to prove mid-day meal scam | | Court acquits ZEO, Ors after 14 years investigation | | Early Times Reporter Jammu | Apr 20 Special Judge Anticorruption Jammu Mr. Kartar Singh yesterday has acquitted BD Sharma the then ZEO Reasi, Parmanand Sr. Asst and Vijay Kumar private respondents from the charges of misappropriating money meant for mid-day meals as Vigilance Organization miserably failed to prove its case. Special Judge Anticorruption, after hearing CPO appearing for the VOJ and Advocates SC Bali and BM Bhardwaj appearing for the accused persons and also going through the record of the case and the investigation conducted by the VOJ, observed that the basic ingredient of the offence of misappropriation are not made out. Similarly, there is no document, which is alleged to have been forged by the accused. It is not the case of the prosecution that the bills prepared and submitted to the treasury were forged or the signatures have been forged by making the payment to the labourers, suppliers and Food and Supplies Department there is no evidence to prove the criminal conspiracy among the accused and no agreement between them has been proved during trial by any leading credible and cogent evidence. The VOJ has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt. They are acquitted of the charges framed against them. According to the Vigilance case, a team of Vigilance organization headed by then Dy SP SR Dutta on March 22, 1994 was on duty to check the treasury at Reasi, during the checking he witnessed the case and proved the fact that three bills sent to the treasury by the ZEO Reasi were found suspicious by him. These bills were sent to the treasury for withdrawal of amount spent for mid-day meals to the school children. After verification it was found that no ration was purchased, the stock verification was conducted in the presence of Executive Magistrate Reasi. On these facts VOJ registered a case under Prevent of Corruption Act r/w section 467, 468, 120-B RPC and after completion of the investigation challan was presented in the Court in the year 1999. |
