| Court awards life imprisonment for murderous assault | | | Early Times Reporter

District Sessions Court, Kupwara today awarded life imprisonment to an accused who had assaulted one person to death about 18 years ago.
On August 16, 1991, Durya Mann, s/o Salam Din lodged a written complaint in Police Station Kupwara against Baju Bagoo and Alam-Din sons of Abdullah Mir, alleging therein that the accused assaulted him when he raised an objection not to raise the construction of their Kotha. He also alleged that the accused struck a strong blow on the head of Alam Din Katana, s/o Fakir Mohd who became unconscious and fell on the ground.
On receipt of the complaint, the aforesaid case was registered against the accused under section 147, 149 and 325 RPC and investigation was set in motion. During investigation the injured was referred to Sub District Hospital Kupwara, wherefrom he was referred to Medical Institute Soura Srinagar, for further treatment. On August 22, 1991 the injured Alam Din succumbed to his injuries and his body was brought to SDH Kupwara, for post mortem. Subsequently, the dead body was headed over to the kin of the deceased for its last rites.
During investigation, the allegations leveled against the accused were found established and accordingly the investigation was closed as challaned against the accused namely Alam Din. The other accused namely Baju and Bagoo were dropped from the array of accused in view of the statements of witnesses recorded under section 161 Cr PC on December 27, 1991.
The challan was produced in the court of law for judicial determination. The charge against the accused was framed on January 10, 1992 under section 302 RPC and prosecution was directed to adduce evidence. In order to prove its case, the prosecution examined 11 witnesses during trial. All the witnesses have corroborated the contents of FIR and as such the prosecution was able to bring home the guilt of the accused under section 302 RPC, who was accordingly convicted and sentenced to life imprisonment by the Court with a fine of Rs, 5000. His bail bond was cancelled and was taken into custody forthwith. The accused has been sent to Central Jail Srinagar. |
