Court stays FIR against ex-VC JDA, others

Jammu, Mar 26: In a criminal revision filed by Ex-VC JDA Pawan Singh Rathore presently Director Agriculture, Devinder Singh Katoch ( Ex Director Land Management J DA), at present Joint Director, ICDS and Shruti Bhardwaj, Tehsildar Jammu Development Authority, Jammu against the order dated 15.03.2019 passed in an application moved under section 156(3) Cr.P.C titled Satpal Sharma vs Pawan Singh Rathore & Ors., by virtue of which the Ld. Chief Judicial Magistrate Jammu has directed registration of FIR u/s 156(3) Cr.P.C against the applicants-petitioners.
Principal Sessions Judge Jammu Vinod Chatterji Koul after hearing Adv Adarsh Sharma appearing for the applicant stayed the order of the CJM Court.
Principal Sessions Judge Jammu VC Koul observed that order impugned has been passed on the applications made by Satpal Sharma, Ishan Sharma and Hardev Singh on the grounds that on 30.09.2018 the accused persons without showing any reason or rhyme on the part of the complainant or issuing any prior notice to the complainant regarding any illegality or any kind of violation committed by the complainant came there along with more than 5 persons and machineries which include bulldozer and started forcibly and illegally demolishing the building raised over the said land when the complainant tried to know about the reasons behind the same they started threatening the complainant of dire consequences.
The offences have been committed by the accused and the complainant is approaching the Court for invoking the jurisdiction of this Court under the provisions of Section 156(3) of Criminal Procedure Code for seeking direction to the SHO P/S Trikuta Nagar Jammu to register FIR against the accused persons under relevant sections.
Court after considering the facts and circumstances of the case and the discussion made herein above, the applicants-petitioners have succeeded in making out a case at this stage for staying the operation of the order Impugned, issue notice to the non-applicants/respondents. In the meanwhile operation of the order impugned shall stand stayed. Court also summoned the record.
