| CRPF faces contempt charges before the State High Court | | | Srinagar, August 29: Delivering a verdict in favour of a deceased CRPF personnel after 17 years, the State high court issued here on Tuesday contempt notices against Central Reserve Police Force (CRPF). Details available indicate that following the sudden death of his mother and daughter, CRPF personnel Mohd Lateef Mir of while on duty at Sumbal had to proceed on 2 months leave, he applied for extension in his leave through a telegram and a registered letter and did not attend his duty for few months. When reported back to duty, the CRPF personnel came to know about shifting of his parent Battalion to Delhi. However he reported to his parent unit for duty, but was arrested and interrogated following which he was asked to report for duty in 22 BN, but was summoned by II nd BN barely few days later and a team was constituted to investigate his case which recommended his dismissal for unauthoreised absence from duty. Consequentially Commandant II nd BN issued orders of his termination from CRPF. However Mohd Lateef Mir challenged the dismissal order before the state high court by filing a writ petition bearing no: 657/88. Advocate B.A. Misri was pleading the case on behalf of the appellant in the state high court and proceedings of the case continued for 12 long years, but Mohd Lateef Mir, the expelled CRPF personnel was killed in a bomb explosion in Uri in the year 2000 following which the wife of the deceased Salima Begum was granted the role of the appellant. Delivering a verdict spread over 8 pages, Justice Hakeem Imtiyaz Hussain observed on May 28, 2005 that evidence put up before the court about the dismissal of CRPF personnel Lateef Ahmed Mir is not enough and hence the dismissal orders are quashed. However the Court granted two months time to CRPF for filing objections and after the expiry of the time granted for the said purpose, Commandant II nd BN CRPF was asked to implement the orders who in a written reply to the court said that without orders of his superiors, he can't comply court orders. Taking strong note of the arguments of Commandant II nd BN R.K.Sharma, Justice N.A Kakroo issued contempt notices to Sharma and directed him to appear before the court in person on September 23, 2006.
