| HC allows petitioners to file amended petition in Sawlakote project case | | | Early Times Reporter Jammu | May 3 In much publicized 1200 MW Sawlakote Hydro Electric Power Project on river Chenab for a cost of Euro 765 million (Rs 53 for 1 Euro), Justice JP Singh of J&K High Court Jammu Wing today permitted the petitioners to file amended petition within two weeks. The petitioners have filed CMP for placing additional documents on records, Sr. Adv Abhishek Manu Shinghvi with Advocates Ritu Bhalla Misha and Pranav Kohli appearing for the petitioners submitted that the petitioners would not press this CMP and would instead seek permission to amend the petition so as to project all those facts which are within their knowledge and grounds. Solicitor General of India J E Valanvati with Adv Reshihash Barva appearing for the respondents while offering no objection to petitioner's request for amendment of petition, submitted that in the event of allowing petitioners’ request for amendment of petition, respondents be also allowed to state all those facts and grounds which may be available to them to meet the case proposed to be set-up by the petitioners in the amendment petition in their counter affidavit. Justice Singh, after considering the submission of counsels for the parties, observed that keeping in view the facts and circumstances of the case, it is considered just and proper to permit the petitioners to file amended petition. Petitioners file amended petition within two weeks with an advance copy to the respondents who may file their response within four weeks thereafter with an advance copy to the petitioners. Rejoinder, if any, may be filed by the petitioners within two weeks thereafter. With these directions Court dismissed CMP filed by the petitioners as not pressed. The petitioner contractors filed petition apprehending fresh tenders. According to the earlier order of State High Court that Contractors of 1200 MW Sawalkote Hydro Electric Power Project on River Chenab in District Doda for a cost of Euro 763 Million (Exchange Rate of Rs 53 for 1 Euro) has challenged the decision to cancel the EPC contract of the petitioners and also to float fresh Global Tender for the EPC contract and seeking quashment and restraining the respondents from acting upon. Earlier, the Court directed State of J&K not to call new global tender and also directed Chief Engineer Power Development Corporation that he will maintain status-quo as it exists that day till next date of hearing. These directions has been issued in a writ petition filed by M/S Sawalkote Prosjektutvikling of Norway, M/S Hindustan Constructions Company Mumbai and M/S Ozaltin Construction Trade and Industry Company of Ankara Turkey against floating fresh global tenders for the EPC contract. |
