| HC rejects bail of rape accused | | | Early Times Report
Jammu, May 18: The J&K High Court has rejected the bail application of a rape accused in Rajouri district.
As per details available with Early Times, the defense counsel, Advocate Mohammed Shaqir Hussain, stated that the challan of the case has been filed before the Court of Additional Session Judge Rajouri and the Investigation Officer arrayed 14 witnesses, out of whom five including the prosecutrix has been recorded.
The defense counsel further stated that the prosecutrix in her statement even stated that there is a land dispute between the family of the applicant and her family.
AAG Advocate Arshad Malik appearing for the government strongly opposed bail to the accused Zabber Hussain Shah and said that considering bail for the accused will encourage the crime against women.
Justice Sanjay Kumar Gupta while rejecting the bail application of the accused stated: "I have gone through the laws cited by the learned counsel for the petitioner. These are not applicable in present set of circumstances of the case. In view of the above, I do not find any merit in this petition. It is dismissed accordingly." |
