Principal Sessions Judge, Jammu, Mr. JR Kotwal, today rejected the bail application of Zahoor Ahmed Koka s/o Ghulam Hussain Koka r/o Malhore Tehsil and District Shopian, who was arrested by the Nowabad police on November 24, 2007 and had recovered over eight kilograms of charas from his possession..
The interim bail application was filed by the accused on the ground to arrange treatment of his ailing wife.
Court, after hearing both the sides, observed that as per the application it is clearly stated that the wife of the applicant developed the heart problem "due to swear shock of the applicant's continued detention". The treatment record of the wife of the accused applicant produced before the Court shows that she is under treatment not after arrest of her husband but ever since the early days of year-2007. In the face of such a contradiction, Court expresses doubts about the genuineness of the ground for bail propounded in the application. With these observations, Court rejected and dismissed the bail application. JNF |
