| Court rejects bail application of Capt Chatnaya | | Investigation takes u-turn, official runner of deceased dies mysteriously | | Early Times Reporter Jammu | May 14 2nd Additional Sessions Judge Jammu Mr. AK Koul today rejected bail application of Captain Chatnaya husband of deceased Capt Megha Razdan. The bail application was filed by the father of accused in which Adv Sunil Sethi and Adv Vishal Kapur appeared for the petitioner and APP Ravinder Sharma appeared for the State. 2nd Additional Sessions Judge while rejecting the bail application observed that petitioner/accused and deceased Capt Megha Razdan both working in Eng, Regt were married in the month of September, 2006, and they had a love affair, which matured in their marriage. Their matrimonial life run into rough weather only sometime after and they started quarrelling. As per record petitioner was having an extra marital relationship with another girl namely Seema Kulkarni of Pune, this relationship created rupture in the married life of petitioner and the deceased. It is being alleged that petitioner was ill-treating the deceased even physically assaulting her, whenever deceased complained about extra-marital relationship and long telephonic conversation with Seema Kulkarni. One fine day deceased was found hanging in her residence Rana Sanga Enclave. Since death was found to have taken place in suspicious circumstances, so inquest proceedings were initiated to ascertain the cause of death, which ultimately led to registration of a case u/s 498-A/306 RPC against petitioner. During investigation scientific aids were also pressed in-service. Brain mapping examination, Narco Analysis and Polygraph examination of petitioner were conducted in forensic science laboratory Madiwala, Bangalore. Once suicide note has also been recovered which has been sent for expert opinion and final report is still awaited. A connected fact though still the subject of investigation, but important is that Vijay Sawant the official runner of deceased Capt also died 18 days after this occurrence in mysterious circumstances. Proceedings under section 134 Cr PC have also been initiated about his death. Court further observed that the evidence oral as well as documentary, collected so far reveals a link between the crime and the petitioner. Sufficient aspects of investigation are the brain mapping, polygraph and Narco Analysis Tests and above all the cell phone record of the petitioner and lady namely Seema Kulkarni who is projected to be the central figure in matrimonial discord of petitioner and deceased. All these facts read together with post-mortem repot findings that there were marks of violence on the body of the deceased apart from a ligature mark on her throat go on to show that deceased had been subject to physical assaults before her death. All this is being attributed to the petitioner. Over and above everything a suicide note has been downloaded from the seized laptops of the petitioner and deceased which are under scrutiny and the final opinion about this is still to come. All these aspects have bearing on the result of the investigation and IO has stated that the petitioner has to be subject to Narco Analysis Test again. Court said that it would not be fear for the Court to discuss the merit of the evidence collected so far but one is constrained to say that the nature of evidence is such that it leads to believe that petitioner is genuinely linked to the Crime of which he has been accused. The fact that deceased had died within one year of her marriage with the petitioner. All these aspects lead to say that petitioner's detention is necessary not only because the accusation is severe but also because of the fact that investigation is in a very crucial phase and in case petitioner is given concession of bail at this stage it may hamper further course of investigation and may ultimately lead to its frustration. With these observations, Court dismissed the bail application of the accused. JNF |
