| HC directs DM to appear in person in obscene poster case | | | Early Times Reporter Jammu | May 17
Justice JP Singh of J&K High Court Jammu Wing today directed District Magistrate, Jammu, to appear in person in the Court to explain as to why contempt of court proceedings are not initiated against him for his willful disobedience of the directions issued by the Court on May 9, 2005 and July 28, 2005. This direction was issued by the High Court in a contempt petition filed by the petitioners seeking initiation of contempt of Court against District Magistrate Jammu. Besides other allegations in the complaint it has been stated by the petitioners that despite issuance of directions by the Division Bench nothing substantial had been done so as to curve menace of obscene posters. Obscene posters which were found pasted in the walls had been photographed by the petitioners on November 13, 2006 from various significant locations of Jammu city. Upon this Court directed District Magistrate Jammu to file statements of facts. Perusal of the statements of facts filed by the District Magistrate Jammu indicates that he has not referred to the complaint which the petitioners had made regarding their finding obscene posters on the walls of Jammu city which had been photographed by them. Justice Singh, after hearing petitioner Arshad Majid Malik, observed that Court prima-facie is satisfied that District Magistrate Jammu has violated the directions issued by this Court on May 9 and July 28, 2005 and directed to appear in person. It was submitted in the petition filed in the State High Court and treated as PIL that obscene posters of cinemas have been pasted on the walls of the city of temples in violation of Cinematography Act and also violating the defacement of Public Property Act and prayed before the Court for issuance directions to the competent Authority to take action under law against the violators. The then Division Bench had disposed off this PIL against obscene posters pasting on the walls of the city of temples. DB had directed District Magistrate Jammu that he shall not allow any film to be exhibited or posters, advertisements, sketch, synopsis or program of film shall be displayed without permission. In case any violation is reported, this court would take a serious view against the District Magistrate. Against this order the petitioner filed the contempt petition in which Justice JP Singh directed District Magistrate Jammu appear in person. JNF
