HC directs respondents to consider petitioners for higher grades

Justice YP Nargotra of J&K High Court Jammu Wing disposed off a petition with a direction to the respondents to consider the case of the petitioners for higher grade on the analogy of the similarly situated persons (ITI Trained).
This significant direction has been passed in a petition filed by the petitioners who were daily wagers and were regularized with effect from April 1, 1998 against the post of helpers and seeking higher grade which was granted to those employees who possessed ITI qualification in different trades because the petitioners also possessed the ITI qualification.
Additional Advocate General SC Gupta appearing for the Works Department submitted that the petitioners are not entitled to the benefit of the higher grade in terms of SROs because they had not been appointed in the higher grade of 4000-6000. They were entitled to receive the salary as per the pay-scale attached with the post of helper.
On the other hand Adv R Kapoor appearing for the petitioner maintained that the petitioners are entitled to the said benefit from the date of their regularization as they possessed the ITI qualification in electrician trade at the time of regularization.
Justice Nargotra, after hearing both the sides and considered the case of the petitioners on the analogy of the similarly situated persons mentioned in the petition subject to the rules. In view of the submissions made in this petition, the petition is disposed off with a direction to the respondents to consider the case of petitioners on the analogy of the similarly situated persons and the appropriate orders shall be passed within two months.
