Govt accords sanction for prosecution former assistant commissioner

In much publicized multi-crore Hill Kaka relief scam, the Govt today accorded sanction for prosecution of in-service accused namely Choudhary Mohd Hafiz the then Assistant Commissioner Revenue Poonch; Maqbool Ahmed the then Junior Assistant DC Officer Poonch; Sohan Singh the then Junior Asst DC Officer Poonch; Ghulam Rasool the then Tehsildar Surankote; Abdul Razaq the then teacher Rehbar-e-Taleem, Mohd Ayub the then Patwari, Mohd Azam the then stock-assistant Animal Husbandry Poonch, Ghulam Hussain the then Junior Assistant DC Officer Poonch, Abdul Rehman the then Sr. Examiner Fund Officer Poonch and Ghulam Abas the then Constable in police dept for commission of offences punishable u/s 5(2) PC Act 2006 r/w section 201, 467, 471 and 120-B RPC whereas no sanction was required for prosecution of private persons and retired employees is required.
In the much publicized scam, the Vigilance Organization had received information ‘through reliable source’ that a large scale alleged misappropriation of public money was caused in the distribution of relief meant for families victimized by operation "Sarpvinash" carried out by the security forces in Hill Kaka area of District Poonch during the year 2005.
A case under FIR No 14/2005 was registered on October 21, 2005 in the P/S VOJ. It was alleged that investigation has revealed that Hill Kaka area is a remote village of District Poonch and in order to eliminate terrorists and to destroy the militant hideouts, the security forces launched operation, to avoid civilian casualty the people leaving in the area were evacuated to safer places and families involved were prohibited to visit Hill Kaka for grazing cattle. The Govt of India released an amount of Rs 7.40 crores which was placed at the disposal of then DC Poonch Mr. Ramzan Thakur who got the entire amount credited in the official bank account of Assistant Commissioner Development Poonch. It is further alleged that then ACD Poonch Choudhary Mohd Hafiz was directed to disburse the relief amount among the beneficiaries. It is further alleged that lists of affected families entitled for compensation had already been prepared by the concerned Tehsildar on the basis of seasonal permits issued to the migratory families during the year 2001 and 2002.
In the investigation conducted by the Vigilance organization it was further alleged that some of the beneficiaries of village sanai and smote were examined during investigation who stated that their photographs were collected Ghulam Rasool then Tehsildar Surankote were made to sign some withdrawal slips of JCC Bank Surankote but no relief money was paid to them. It is further alleged that Ghulam Rasool then Tehsildar Surankote and Mohd Ayub then Patwari have deceitfully opened 13 bank accounts in the name of different beneficiaries and subsequently withdrew money from these accounts through cheques. It is further alleged that investigation has found that the accused public servants have by abused of their official position dishonestly and fraudulently shown disbursement of relief in favour of 283 beneficiaries while as only 34 beneficiaries were found genuinely paid in accordance with their actual entitlement. 26 beneficiaries though entitled were paid relief much in excess of their entitlement, six beneficiaries were paid twice and 217 beneficiaries were found not eligible to the Hill-Kaka relief. In this manner the accused public servants were found to have caused a loss of 24668057/- to the State Exchequer.
The Govt after considering record and evidence collected in the case by the investigating agency and applying its mind to the fact and circumstances of the case is satisfied that prima-facie case for the commission of offences is made out against the official in service accused, retired Govt employees and private beneficiaries and accorded sanction vide order No 41-GAD (VIG) of 2008 dated May 21, 2008.
