| SAC dents two IAS officers for 'unthinking' working style | | Tehsildar, two other Revenue officials' termination recommenced in false mutation | | Early Times Reporter Jammu | May 30 In one its most stringent orders, the State Accountability Commission has come down heavily on two top IAS officers –both presently Commissioner Secretaries to the government –for the perfunctory style of working even as it recommended termination of services of a Tehsildar and two other junior revenue officers. In a complaint filed by one Magotam Das of Udhampur, the SAC observed that two IAS officers Atal Dullo and Ashok Parmar –who had served as Deputy Commissioners in Udhampur –did not apply mind on a case which prejudiced by a Tehsildar, Girdawar and a Patwari. While SAC has recommended termination of the services of Tehsildar, Girdawar and Patwari it asked government to take action against both IAS officers. The complaint says that Patwari of the Village Chak-Rakwalan, Saleem Banday had recorded the possession of one Jeet-Singh as owner in crop record, on the basis of unregistered lease deed for 3 Kanals and 11 Marlas of land situated at Chak-Rakwalan Tehsil Udhampur, despite full knowledge that the land having vested in the prospective owner u/s 8 of Agrarian Reforms Act 1976, no right could be transferred in view of the section 28 (A) of Agrarian Reforms Act in favour of Jeet Singh. It is further OM Parkash then Girdawar, Basant Ram then Tehsildar not only gave their approval to the entry effected by the Patwari in favour of Jeet Singh as owner without any legal basis, but also attested the mutation in violation of section 28-A of Act, whereby the land had vested in the State. On enquiry by the Commission, it was found that ownership of state land measuring 3 Kanal 11 Marlas in Survey No 1137 had vested in the complainant u/s 8 of the Agrarian Reforms Act. It was also found that Patwari, Girdawar and Tehsildar of Udhampur recorded entry of ownership of Jeet Singh as transferee-cum-cultivator vide mutation No 1382. The complainant owner of land had filed a complaint before the Atul Dullo then Deputy Commissioner Udhampur who ordered an enquiry through Assistant Commissioner Revenue Udhampur, vide his report February 4, 2003 submitted that the mutation No 1382 showing Jeet Singh as transferee-cum-cultivator of said land was not legal sustainable. It was found during enquiry by the Commission that Mr. Atul Dullo did not take any action for two long years against the Patwari, Girdawar and Tehsildar for their illegal Acts. It was also noticed by the SAC that another Deputy Commissioner Mr. Ashok Parmar who succeeded Mr. Atul Dullo had did not take action on the complaint of the complainant but remained mute spectator to the misdeed of his subordinate. Regarding the conduct of the Tehsildar, the SAC observed that the Tehsildar with one stroke of pen recorded and attested the mutation to divest the complainant of all the rights that had vested in him, in respect of the land in question, under the law. The Tehsildar did not afford any opportunity to the complainant to project his case. The Tehsildar was afforded time and opportunity in proceedings to come with the record or identify the records whereby it could be show that he had afforded the opportunity of hearing to the complainant, Tehsildar neither produce any record nor has identified the proceedings to show that opportunity of hearing had been afforded. The mutation order in reference also does not even hint that the complainant had been afforded the opportunity of hearing. The commission after conclude its finding made recommendation for the termination of the services of the Patwari, Girdawar and Tehsildar. |
