Court rejects bail to husband in dowry death

Special Mobile Magistrate Electricity Jammu Mr. MK Sharma today rejected the bail application of Dimple Sambyal husband of deceased Bharti Sharma, who died on May 6, 2008 by allegedly consuming some poisonous substance.
According to the police report the father of Bharti Sharma filed a complaint with the police that his daughter w/o accused died on May 6, 2008, it was alleged that the deceased Bharti Sharma who got married to accused Dimple Sambyal in July, 2007was subjected to harassment following demands of dowry by the accused and family members of the accused.
On the written complaint of the father of deceased, police registered a case u/s 306/498-A RPC and accused was arrested. The accused filed this bail application through his elder brother.
Special Mobile Magistrate Electricity Jammu MK Sharma after hearing both the sides and also going through the police report and case dairy observed that in the present case the accused has been charged for the commission of offence u/s 306/498-A RPC. The offences are serious in nature whereas offence u/s 306 RPC is punishable with imprisonment of either description for 10 years and fine. The victim was a young girl who died at the prime of her life. The offences against the women are on rise and concessions of bail in such offences results in encouragement to perpetrators of the crime. It shall, therefore, be in the interest of the public not to grant bail to the accused. With these observations the court rejected the bail application. JNF
