| HC stays selection process of GMC registrars | | | Early Times Reporter Jammu | June 5 Justice YP Nargotra of J&K High Court Jammu Wing today stayed the selection process regarding the post of registrar in terms of advertisement notice issued by the Principal GMC Jammu dated May 8, 2008 relating to the discipline of Surgery and Orthopedics till further orders. This significant order passed in a three writ petitions filed by Dr. Suchi Gupta, Dr. Gagan Gopal Bali (Surgery) and Dr. Neeraj Mahajan Orthopedics challenging the recruitment rules mentioned in the advertisement notice. Adv RK Gupta appearing in all the three petitions challenging the validity of the advertisement notice in which two years condition was imposed on the ground that Schedule of J&K Medical Education (Gazetted) Service Recruitment Rules 1979 prescribed only one years experience as a House Officer or equivalent recognized experience of Assistant Surgeon appointed in terms of said rules, whereas the impugned advertisement notice prescribed experience of two years as Assistant Surgeon, which is as such, in contravention to the statutory recruitment rules. According to the Adv Gupta the petitioners have applied for the post of Registrar, pursuant to the said advertisement in discipline of Surgery and orthopedics, but though eligible in terms of the recruitment rules, their candidature is not been considered on the ground that they does not fulfill the requirement of two years experience as per the advertisement notice dated may 8, 2008. Justice YP Nargotra after hearing counsel appearing for the petitioners, issued notice and in the meanwhile the selection process regarding the post of registrars in terms of the said advertisement notice relating to the discipline of Surgery and Orthopedics, shall remain stayed till further orders and also directed the registry to list immediately after the service, and also permitted Dasti Service.
