| HC issues fresh orders in PIL about ban on entry, use sale of polythene | | | SRINAGAR, AUGUST 31– The High Court of Jammu and Kashmir at Srinagar with Chief Justice Mr. Justice B.A. Khan and Mr. Justice Bashir A. Kirmani in coram in the PIL S.R. Institute v/s State of Jammu and Kashmir and others has issued fresh orders which read as under:- “The State Government through its Chief Secretary is directed to file a status report indicating the compliance of Court order dated 18-05-2006 which envisages passing of consequential orders by the concerned governmental agencies for implementing the ban order passed by the Court and convene a meeting of all the concerned departmental heads etc for evolving and adopting a suitable plan of action and any appropriate mechanism for enforcing this ban. This Court has already directed concerned authorities to explore the proposed legislation regarding ban on manufacture, sale and use of polythene in the state of Jammu and Kashmir. No authority has come forward to inform this Court about the status of this legislation or any further proposed draft legislation, which is said to have been put up for consideration by the Pollution Control Board. The state through Chief Secretary is accordingly directed to expedite the consideration of the draft legislation and all concerned functionaries are directed to accord their respective clearance with or without any modification. The Deputy Commissioners of Srinagar, Baramulla and Anantnag alongwith SSPs of these three districts and also the Chairman, Pollution Control Board, the Chief Executive Officers of Gulmarg, Pahalgam and Sonamarg Development Authorities, the SHOs and Tehsildars of these areas are directed to submit their status reports showing compliance of the Court orders and to appear in person before the Court for any further clarification or assistance on the next date of hearing. Their status reports shall show the steps taken by them so far and proposed to be taken to enforce the ban order in their areas of jurisdiction”.
