| HC directs respondent to regularize services of retired daily wager | | | Early Times Reporter Jammu | June 9 Coming to the rescue of the petitioner seeking regularization as a daily wager after his superannuation in 2005, Justice YP Nargotra of J&K High Court Jammu Wing today directed Director Sericulture Development Department to accord consideration to the case of the petitioner and pass appropriate orders relating to his regularization within a period of two weeks. The petitioner, an ex-serviceman was discharged from CRPF in the year 1976, without grant of any pension and was engaged as daily wager in the office of Director Sericulture Development Jammu on February 15, 1990. He worked their as daily wager till he superannuated from service on September 30, 2005. The claim of the petition is that after having remained in service for a period of more than seven years he was entitled to regularization in terms of SRO 64 of 1994, but when he was not regularized he filed the present petition seeking direction to the respondents to regularize him from the date he was entitled to and also claimed consequential benefits. Justice Nargotra while disposing off the petition with the directions, observed that Adv KK Pangotra appearing for the petitioner submitted that since the eligibility of the petitioner for regularization is not disputed by the respondents in their objections, rather it has been stated that his case has been cleared by the Finance Department, subject to certain conditions, formal orders of regularization are awaited. Adv Pangotra further submitted that petitioner would be satisfied if respondents are directed to consider the case of the petitioner and appropriate orders passed. On the other hand Deputy AG Vinod Bakshi appearing for the respondents submitted that respondents would have no objections for according consideration to the case of the petitioner and for passing appropriate orders of his regularization. In view of the submissions made, HC disposed off this petition with the direction to respondents to accord consideration to the case of the petitioner and pass appropriate orders relating to his regularization within a period of two weeks.
